General Terms and Conditions (GTC)

1. General

1.1. These General Terms and Conditions (“GTC”) apply to orders, sales and deliveries of products that are offered and sold via the online shop at www.wobbelstopper.com.

1.2. The operator of the online shop and contracting party is:

1.3. The contract language is German.

2. Scope

2.1. These GTC apply to contracts with consumers within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG).

2.2. Deviating, conflicting or supplementary terms of customers do not become part of the contract unless their application is expressly agreed to in writing.

3. Changes to the GTC

3.1. Each purchase is governed by the GTC that are available in the online shop at the time of the order.

3.2. The seller reserves the right to amend these GTC for future orders. Contracts already concluded remain unaffected.

4. Customer account

4.1. Customers can create a customer account in the online shop. To create a customer account, the required details must be provided completely and correctly.

4.2. Orders can also be placed without a customer account.

4.3. Customers are obliged to keep their login details confidential and to protect them from access by unauthorized third parties.

5. Ordering and conclusion of the contract

5.1. The products shown in the online shop do not constitute a legally binding offer, but an invitation to place an order.

5.2. The ordering process consists of the following steps:

  • Selecting the desired product
  • Adding the product to the cart
  • Checking the cart
  • Entering the billing and delivery details
  • Selecting the shipping and payment method
  • Checking and, where necessary, correcting the order
  • Bindingly submitting the order by clicking the “Buy now” button

5.3. Before submitting the order, customers can check and correct their entries at any time.

5.4. By clicking the “Buy now” button, the customer submits a binding offer to conclude a purchase contract.

5.5. After the order has been received, the customer receives an automatic confirmation by email. This order confirmation confirms receipt of the order but does not yet constitute acceptance of the offer to purchase, unless acceptance is expressly declared in it.

5.6. The purchase contract is concluded as soon as the seller expressly accepts the order, ships the goods or sends a shipping confirmation or order acceptance.

5.7. Images, drawings and product presentations in the online shop are for illustration purposes. Minor, objectively justified deviations are reserved, provided they are reasonable for customers.

5.8. Customers must ensure that all details provided in the course of the order are correct, complete and up to date.

6. Prices, shipping costs and invoices

6.1. All prices stated in the online shop are in euros and include statutory value added tax, unless expressly stated otherwise.

6.2. Additional shipping costs are shown in the cart and at checkout before the order is completed.

6.3. Shipping costs are currently as follows, in each case including statutory value added tax and charged once per order: Austria €17.10 for the Wobbelstopper 4K and €24.60 for the Wobbelstopper 6K, Germany €25.50 and €32.90 respectively, Netherlands €28.70 and €35.70 respectively, other delivery countries €40.00. If an order contains several units, the higher rate is charged once.

6.4. Pickup at the seller’s premises, Gewerbepark Harbach 35, 5630 Bad Hofgastein, Austria, is free of charge and can be selected as the shipping method at checkout.

6.5. For deliveries to other selectable delivery countries, the applicable shipping costs are shown at checkout.

6.6. After the contract has been concluded, the seller sends an electronic invoice. Customers agree to receive an electronic invoice.

7. Payment methods

7.1. Depending on the delivery country, cart, device, browser and technical availability, various payment methods are available in the online shop.

7.2. At present, the following payment methods in particular may be offered:

  • Credit / debit card via Stripe
  • Klarna via Stripe
  • EPS via Stripe
  • PayPal

7.3. The payment methods actually shown at checkout are always decisive.

7.4. Payments are processed by the respective payment service provider. The terms of the respective payment service provider may additionally apply to the use of individual payment methods.

8. Delivery and delivery times

8.1. Delivery is made to the delivery address stated in the ordering process and to the delivery countries selectable at checkout.

8.2. The seller delivers within the European Union. The available delivery countries are shown in the ordering process. Deliveries outside the European Union are possible by prior arrangement.

8.3. The delivery time depends on the product and is shown directly with the product as well as in the cart and at checkout.

8.4. At present, the following delivery times in particular may be shown:

  • Ready to ship in 3 to 5 working days
  • Currently not available

8.5. For orders with several products, the delivery time may be determined by the product with the longest delivery time.

8.6. Unless a different delivery time is stated for the product, delivery takes place within 30 days of conclusion of the contract at the latest.

8.7. If a delivery period cannot be met due to circumstances beyond the seller’s control, the delivery period is extended appropriately. In this case, customers will be informed as soon as possible.

9. Retention of title

9.1. The delivered products remain the property of the seller until the purchase price and any ancillary costs have been paid in full.

10. Right of withdrawal

10.1. As a rule, consumers have the right to withdraw from the contract within fourteen days without giving any reason.

11. Statutory warranty

11.1. The statutory warranty provisions apply.

11.2. In the event of a complaint, please contact:

11.3. Please describe the defect as precisely as possible and, where helpful, send us photos of the product or of the damaged packaging.

11.4. In the case of justified warranty claims, the seller bears the costs provided for by law.

11.5. The request to report visible transport damage as promptly as possible has no effect on statutory warranty rights.

12. Liability

12.1. The seller is liable without limitation for damage arising from injury to life, body or health and for damage caused intentionally or by gross negligence.

12.2. For damage caused by slight negligence, the seller is liable only in the event of a breach of essential contractual obligations and only to the extent permitted by law.

12.3. Statutory claims under mandatory consumer protection provisions remain unaffected.

13. Product information and use

13.1. The product information, descriptions and notes provided in the online shop have been prepared with care. Customers are nevertheless obliged to observe the respective product details, instructions for use and safety information.

13.2. The products must be used properly and in accordance with the respective product description.

13.3. Product details on effect, function and area of use relate to the conditions described in the online shop. Deviations may arise in particular from different boats, rigging situations, and weather, water and usage conditions.

14. Reviews

14.1. Product reviews may be displayed on the website.

14.2. Information on whether and how reviews are checked for authenticity can be found on our page Authenticity of reviews.

15. Data protection

15.1. Information on the processing of personal data can be found in our privacy policy.

16. Applicable law

16.1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

16.2. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which the consumer has their habitual residence.

17. Dispute resolution

17.1. The European Commission provides a platform for online dispute resolution. It can be reached at the following link:

17.2. The seller is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board, unless there is a legal obligation to do so.

18. Final provisions

18.1. Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected.

18.2. Customers are obliged to notify changes to their contact and delivery details insofar as these are relevant to the performance of the contract.
